These Terms and Conditions ("Terms") govern access to and use of the website bookedspas.com and the AI-powered virtual receptionist services provided by BookedSpas ("BookedSpas," "we," "us," or "our"). By using our website or services, you agree to these Terms.
1. Our Services
BookedSpas provides AI-powered virtual receptionist services to medical spa and wellness businesses ("Clients"). Our AI receptionist answers inbound calls on behalf of a Client, assists callers with common requests (such as booking inquiries and business information), and sends internal call-summary notifications to the Client's own staff.
2. Client Relationship
Businesses that engage BookedSpas ("Clients") do so under a separate service agreement, order form, or trial arrangement, which governs pricing, service levels, and specific terms of the engagement. These website Terms apply in addition to, and do not replace, any such separate agreement.
3. Acceptable Use
You agree not to use our website or services to violate any applicable law or regulation; interfere with or disrupt the operation of our services; attempt to gain unauthorized access to our systems or another Client's data; or use the service to send unsolicited or unlawful communications.
4. Intellectual Property
All content on this website, and the underlying BookedSpas platform and technology, are owned by BookedSpas or its licensors and are protected by applicable intellectual property laws. Clients are granted a limited right to use the service as described in their service agreement; nothing in these Terms transfers ownership of our technology.
5. Third-Party Callers
Individuals who call a Client's business phone number and are assisted by our AI receptionist are not themselves customers of BookedSpas. Their interaction is with the Client's business, and BookedSpas acts as a service provider to that Client. Call information is used only to serve that Client, as described in our Privacy Policy.
6. Disclaimers
Our services are provided "as is" and "as available." While we work to keep our AI receptionist accurate and reliable, we do not guarantee that it will be error-free, uninterrupted, or fully accurate at all times. Clients remain responsible for verifying important appointment and business information conveyed to their customers.
7. Limitation of Liability
To the fullest extent permitted by law, BookedSpas will not be liable for indirect, incidental, special, or consequential damages arising from use of our website or services. Our total liability for any claim relating to our services will not exceed the amount paid by the Client for the service during the three (3) months preceding the claim, unless otherwise stated in a separate service agreement.
8. Changes to These Terms
We may update these Terms from time to time. Continued use of our website or services after changes take effect constitutes acceptance of the updated Terms.
9. Governing Law
These Terms are governed by the laws of the state in which BookedSpas is based, without regard to conflict-of-law principles.
